What is a Divorce Settlement Agreement?

Even if you and your spouse haven’t agreed on every detail yet, I can still help you by drafting a proposed agreement based on your current preferences and objectives. This initial draft serves as a starting point for discussion and negotiation. Sometimes, simply putting everything in writing makes it easier to identify areas of agreement and narrow down the points of disagreement.

 What if we don’t agree on everything yet?

Yes. Once both parties sign the Marital Settlement Agreement (MSA) and it is submitted to the court as part of the divorce proceedings, the judge will review it to ensure it is fair, complete, and legally sound. If approved, the agreement is formally incorporated into the final divorce judgment.  If either party fails to comply with the agreement, the other party can return to court to seek enforcement.

 Is the agreement enforceable in court?


The time varies depending on the complexity of your financial and family situation, how much information is readily available, and the level of cooperation between you and your spouse. If both parties are generally in agreement and are responsive in providing necessary documentation and feedback, a straightforward agreement can often be drafted within 1 to 3 weeks.

How long does it take to prepare the agreement?


Yes. In most uncontested divorce cases, courts require a signed Marital Settlement Agreement (MSA) in order to finalize the divorce. An uncontested divorce means that both spouses are in agreement about all major issues—such as how to divide property and debts, whether spousal support will be paid, and, if applicable, arrangements for child custody and support.
